These terms of use (General Conditions) constitute a contract between any person (hereinafter referred to as User or Users) who wishes to access and/or use the SE Transaccionales Wallet service of SE Transaccionales S.A. de C.V. (SE Transaccionales, we, our, and similar terms as appropriate), in which case the User will be subject to the terms and conditions governing SE Transaccionales.
These General Conditions describe the rights and responsibilities of the User and SE Transaccionales when using the payment processing service, the platform, and any related product or service offered by SE Transaccionales (collectively, the Service).
The User must read, understand, and accept all the conditions set forth in these General Conditions and other policies and principles incorporated therein by reference, prior to registering as a User of SE Transaccionales and/or using the Service.
Any person who does not accept these general terms and conditions, which are mandatory and binding, must refrain from using the site and/or the services.
Prohibited Uses. The User declares that the purpose for which they use the service does not infringe any applicable law, nor is it for a service, sale, or transmission that is prohibited by law or the General Terms and Conditions of SE Transaccionales, including but not limited to: (i) gambling, betting, etc.; (ii) arms trafficking, human trafficking, animal trafficking, etc.; (iii) money laundering and/or terrorism; (iv) pornography, prostitution, or pedophilia; and/or (vi) any type of activity that may be considered fraudulent or illegal or suspicious of being so.
The user may not: (i) remove any copyright notice, trademark, or other proprietary notice from any part of the Services; (ii) reproduce, modify, create derivative works based on the Services, distribute, license, lease, resell, transfer, publicly display, publicly perform, transmit, retransmit, or otherwise exploit the Services, except as expressly permitted by SE Transaccionales; (iii) decompile, reverse engineer, or disassemble the Services, except as permitted by applicable law; (iv) link to, mirror, or frame any part of the Services; (v) cause or launch any program or script with the purpose of extracting, indexing, analyzing, or otherwise mining data from any part of the Services or unduly overloading or blocking the operation and/or functionality of any aspect of the Services; or (vi) attempt to gain unauthorized access or damage any aspect of the Services or their related systems or networks.
Subject to compliance with these Conditions, SE Transaccionales grants you a limited, non-exclusive, non-sublicensable, revocable, non-transferable license to: (i) access and use the Applications on your personal device only in connection with your use of the Services; and (ii) access and use any content, information, and related materials that may be made available through the Services, solely for your personal, non-commercial use. SE Transaccionales and its licensors reserve any rights not expressly granted herein.
The Services and all rights relating thereto are and will remain the property of SE Transaccionales or its licensors. None of these Conditions or your use of the Services transfer or grant you any rights: (i) in or with respect to the Services, except for the limited license granted above; or (ii) to use or refer to SE Transaccionales' company names, logos, product and service names, trademarks, or service marks, or those of its licensors, in any manner.
The Service is not available for use by individuals under the age of 18. You may not authorize third parties to use your Account, nor may you allow individuals under the age of 18 to receive services. You may not assign or otherwise transfer your Account to any other person or entity. You agree to comply with all applicable laws when using the Services and may only use the Services for lawful purposes. In using the Services, you will not cause any disruptions, annoyances, inconveniences, or damage to property, whether of the Third-Party provider or any other party. In some cases, you may be required to provide identification documents or other identity verification elements for access or use of the Services, and you agree that access or use of the Services may be denied if you refuse to provide the identification document or identity verification element.
The user undertakes to act in good faith using the services offered by SE Transaccionales under the current and applicable law.
SE Transaccionales is not responsible for purchases made by the user through the applications and/or their physical SE Transaccionales card, nor for the quality, integrity, delivery time, or suitability of the services or products acquired. The user undertakes to act in good faith using the services offered by SE Transaccionales under the current and applicable law.
All personal data provided by the User for registration purposes through the Mobile App and/or Website is protected in compliance with the Federal Law on Protection of Personal Data Held by Private Parties and SE Transaccionales' Privacy Notice, which can be consulted on the SE Transaccionales Mobile App.
The user is responsible for obtaining the necessary data network access to use the Services. Data and messaging rates may apply from your mobile network if you access or use the Services from a wireless device, and you will be responsible for those fees and rates. You are responsible for acquiring and updating the compatible hardware or devices required to access and use the Services and Applications and any updates thereto. SE Transaccionales does not guarantee that the Services, or any portion thereof, will function on any particular hardware or device. Additionally, the Services may be subject to malfunctions or delays inherent in the use of the internet and electronic communications.
SE Transaccionales is not responsible for the user's use of their mobile device, nor for the applications or sites visited by the user from their device. SE Transaccionales is also not responsible for any hacks or attacks on the device resulting from its use. Similarly, the user is responsible for any expenses incurred for data loss or repairs to the mobile device in any case.
The Services constitute a technology platform that allows users of SE Transaccionales mobile applications as part of the Services to link their third-party debit card, check balances of their SE Transaccionales card, review transaction history made with the application, and make transfers, pursuant to an agreement with SE Transaccionales or certain affiliates of SE Transaccionales ("Third-Party Providers"). YOU ACKNOWLEDGE THAT SE Transaccionales IS NOT A FINANCIAL INSTITUTION.
Every user who wishes to use the Service must register with SE Transaccionales and accept these General Conditions. Registration requires filling out the registration form with valid data and providing accurate, precise, and true personal information ("Personal Data"). The user undertakes to update the Personal Data as necessary. SE Transaccionales is not responsible for the accuracy of the Personal Data provided by its users. Users guarantee and are responsible, in any case, for the truthfulness, accuracy, completeness, validity, and authenticity of the entered Personal Data. All information and Personal Data provided by the user are considered sworn statements.
SE Transaccionales reserves the right to request proof and/or additional information in order to verify the information provided by a user regarding Personal Data, as well as to temporarily or permanently suspend those users whose data could not be confirmed.
SE Transaccionales reserves the right to reject a registration request or to cancel or suspend an account, temporarily or permanently, in the event of inconsistencies or discrepancies in the information provided by a user or if suspicious activities are detected. Such decisions shall not entitle the user to any compensation or indemnification.
Every successfully registered user will receive a digital SE Transaccionales card automatically linked to the SE Transaccionales wallet. The digital card, which is personal and non-transferable, allows the user to make purchases of products, goods, and services. Additionally, upon request by the customer, SE Transaccionales may, at its sole discretion, issue a personalized and non-transferable plastic card in the customer's name, which allows the customer to make purchases of products, goods, and services. The user will accumulate loyalty points from participating merchants on this card.
However, once the user has received access to the Account and/or received the Card, it is the user's responsibility to take care of, safeguard, and use it properly. In case of theft or loss, it must be reported immediately.
To use the payment method through the Card, the customer must provide the necessary funds to SE Transaccionales through the SE Transaccionales Reload System. Until such funds are made available to SE Transaccionales and the Card is activated, it will have no value.
Therefore, the user declares under oath and undertakes that the funds deposited in the Account are owned by them and originate from lawful sources. The user acknowledges and fully understands the provisions related to transactions involving funds of illicit origin and their consequences. Furthermore, the user agrees not to register the SE Transaccionales Profile within the Mobile App under the name or account of a third party, and therefore, will always act on their own behalf.
The user can’t exceed the funding amount in the course of a calendar month equivalent to 29,000 UDIs, and depending on the value of the UDI at the time of the transaction, it would be ($180,000.00 one hundred and eighty thousand Mexican pesos 00/100 M.N). However, the Financial Entity may discretely increase these limits based on the information provided by the user and in compliance with its internal AML processes.
The user can link debit and credit cards from financial institutions other than SE Transaccionales to the wallet. Once linked, the user can view the transaction history made through the wallet and transfer funds to their SE Transaccionales card. The user will not be able to check the available balance of cards from institutions other than SE Transaccionales. SE Transaccionales is not responsible for the availability of funds on cards from institutions other than SE Transaccionales. Similarly, SE Transaccionales is not responsible for purchases made by the user with physical cards from third parties and/or through applications from providers other than SE Transaccionales, nor for the quality, integrity, delivery time, or suitability of the acquired services or products.
The user can review the details of transactions made through the Mobile App. In case there is an error in the transaction details, the user has 30 (thirty) calendar days to notify SE Transaccionales through the Mobile App. After this period, it will be understood that the user agrees with their transactions, and no claims can be initiated thereafter.
SE Transaccionales provides support 365 days a year, if needed. To receive support, you can go to the "Help" section located in the main menu of the application.
The limitations and waivers in this section are not intended to limit liability or alter your rights as a consumer that cannot be excluded under applicable law.
The services are provided "as is" and "as available." SE Transaccionales waives all representations and warranties, express, implied, or statutory, not expressly stated in these conditions, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Furthermore, SE Transaccionales makes no representation or warranty regarding the reliability, timeliness, quality, suitability, or availability of the services or any of the services or goods requested through the use of the services, or that the services will be uninterrupted or error-free. SE Transaccionales does not guarantee the quality, suitability, safety, or ability of third-party providers. You agree that all risks arising from your use of the services and any service or goods requested in connection therewith will be solely yours, to the maximum extent permitted by applicable law.
SE Transaccionales shall not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, including lost profits, loss of data, personal injury, or property damage, nor for damages relating to, or arising out of, or in connection with any use of the services, even if SE Transaccionales has been advised of the possibility of such damages. SE Transaccionales shall not be liable for any damages, liability, or loss arising out of: (I) your use or reliance on the services or your inability to access or use the services; or (ii) any transaction or relationship between you and any third-party provider, even if SE Transaccionales has been advised of the possibility of such damages. SE Transaccionales shall not be responsible for delay or failure to perform resulting from causes beyond the reasonable control of SE Transaccionales.
SE Transaccionales shall not be responsible for any damage, harm, or loss suffered by a user caused by system failures, server issues, or the internet. It shall also not be responsible for any viruses that may infect the user's equipment as a result of accessing, using, or examining the Website and/or Mobile App or as a result of any data, files, images, texts, or audio transferred through them. Users shall not attribute any responsibility or claim compensation for damages resulting from technical difficulties or failures in systems or the internet. SE Transaccionales does not guarantee continuous or uninterrupted access and use of its Mobile App and Services.
In no event shall SE Transaccionales' total liability to you in connection with the services for all damages, losses, and causes of action exceed five hundred dollars ($500) or its equivalent in the national currency.
You agree to indemnify and hold SE Transaccionales and its officers, directors, employees, and agents harmless from any claim, demand, loss, liability, and expense (including attorney's fees) arising out of: the Platform, the Services, SE Transaccionales Profile, Card, or Account, as well as any fraudulent or unlawful transactions.
You agree to indemnify SE Transaccionales, its employees, officers, directors, affiliates, suppliers, vendors, partners, and advisors from any action, demand, or claim (including attorney's fees and court costs) arising from any breach by you of these Terms of Use. To this end, SE Transaccionales will promptly notify you of any demand, action, or proceeding.
Each user shall be responsible for all tax obligations and burdens arising from their operations on the Platform, and SE Transaccionales shall not be held liable for any non-compliance by users. SE Transaccionales is not responsible for ensuring compliance with tax or fiscal obligations established by applicable law or any other obligations arising from the provision of the Services or these Terms of Use.
In the event that you encounter any issues with the use of the Services and/or believe that any part of these Conditions is not being observed or complied with by SE Transaccionales, or if any dispute arises between the Parties relating to these Conditions, you agree that the first step is to communicate the situation through the Help section of the SE Transaccionales platform.
If you believe that the resolution of the case is not satisfactory to your interests, the Parties agree that such dispute will be finally resolved as follows:
These Terms of Use shall be governed by the laws of Mexico City, regardless of the User's place of residence, the type of Services, or the location where the Services are provided. Furthermore, in the event of any dispute, the parties submit exclusively to the jurisdiction and competence of the federal courts in Mexico City and expressly waive the jurisdiction of any other court that may correspond to them based on their current or future domiciles.
You may not assign or transfer these Conditions, in whole or in part, without the prior written consent of SE Transaccionales. You give your approval to SE Transaccionales to assign or transfer these Conditions, in whole or in part, including to: (i) a subsidiary or affiliate; (ii) a purchaser of SE Transaccionales' capital, business, or assets; or (iii) a successor by merger. There is no joint venture, partnership, employment, or agency relationship between you, SE Transaccionales, or any Third-Party provider as a result of the contract between you and SE Transaccionales or the use of the Services.
If any provision of these Conditions is deemed illegal, void, or unenforceable, in whole or in part, under any legislation, such provision or part thereof shall be deemed not to be part of these Conditions, although the legality, validity, and enforceability of the remaining provisions of these Conditions shall not be affected. In such a case, the parties shall replace such illegal, void, or unenforceable provision, in whole or in part, with a legal, valid, and enforceable provision that, to the extent possible, has a similar effect as the illegal, void, or unenforceable provision, given the contents and purpose of these Conditions. These Conditions constitute the entire agreement and understanding between the parties with respect to the subject matter and supersede and replace all prior or contemporaneous agreements or contracts regarding such subject matter. In these Conditions, the words "including" and "includes" mean "including, without limitation."
